Funding your Motoring Case
At Stock Moran Swalwell we understand that being accused of a motoring offence is stressful enough without having to worry about the costs of defending your case spiralling out of control.
This means that we conduct most of our cases on a fixed fee basis which means that you will have the certainty of knowing how much your case will cost at the very outset. There will be no hidden fees or surprises; what we quote is what you pay. If you are not eligible for legal aid, our fixed fees start from £250 excluding VAT and disbursements for guilty pleas. The fee includes 1 hour attendance and preparation, considering evidence and advocacy at the Magistrates' Court (providing the case lasts no more than half a day). The fixed fee does not include instruction of any expert witnesses, taking statements from any witnesses, or any contested hearing including special reasons or exceptional hardship arguments. There is an assumption that the travel time is no more than 1 hour for the whole journey and the case is finalised on the first hearing. Travel disbursements are not included. As part of the service we will obtain evidence from the prosecution, discuss this with you, providing clear and concise advice in relation to it. We will explain court procedure, and the likely outcome of your case. If necessary we will answer any follow up queries as well as any advice on a potential appeal. If your case is particularly complex or requires specialist preparation, we also carry out work on an hourly fee basis. If your case falls into this category we will give you an estimate of the costs at the outset and provide you with regular updates of the costs as your case progresses. If you do fund your case privately and you are subsequently found "not guilty" we can apply to the court for your defence costs to be reclaimed. |
