Special Reasons for Non-Disqualification or Endorsement
In normal circumstances when you are convicted of certain driving offences, your sentence would include an endorsement of penalty points on your licence, or a disqualification from driving. It is sometimes possible, however, to argue that "special reasons" exist in the particular facts of your case which mean that the Court should not impose the penalties which normally flow from a conviction.
If you seek to run this kind of argument the onus is on you to prove that your account of the circumstances is correct. The "special reasons"must not be a defence in law to the charge, they must relate directly to the offence, they must be extenuating or mitigating circumstances and must be something which the Court ought to take into account when deciding what punishment to impose. There is no set list of what might amount to a "special reason".
